°°° Resume : L'elaboration d'une constitution europeenne doit determiner
l'equilibre des institutions europeennes et nationales, donner une
definition precise des droits fondamentaux, qui sont egalement contenus
dans la Charte europeenne des droits fondamentaux, et se faire en
collaboration avec la societe civile meme si les chefs d'Etat europeens ne
se sont pas montres enthousiastes a cette idee. Ce forum peut, en ce sens,
permettre l'expression de cette societe civile. °°°
A propos de constitution, democratie et Charte europeenne des droits
fondamentaux, le debat ouvert par Sandro
[<http://www.funredes.org/alianza/eur-gov-alliance/0066.html> (*)] est
interessant sur le plan philosophique, sur celui de la philosophie de
l'histoire (cf. Arnold Toynbe in "L'Histoire") et sur celui de
l'ethique.(reflexion sur l'ethique des Verites, plus que sur la seule
ethique des droits).
Une "saillie hors des savoirs" de l' Etre en meme temps qu'une
"perseverance dans l'Etre" me semblent convoquees par l'elaboration d'une
Constitution donc par une meditation sur sa visee : "droits vitaux ",
assures pour chacun, etc.
Un effort de description precise des droits europeens fondamentaux garantis
et du jeu harmonieusement equilibre des institutions relevant d'une
constitution europeenne serait un imperatif majeur. De meme, les
articulations institutionnelles, structurelles et administratives destinees
a assurer les liaisons et a delimiter les champs de competence et de
juridiction entre le "Gouvernement europeen" et les Gouvernements des Etats
europeens imposent des definitions precises.
Pour qu'une telle elaboration puisse aboutir a un texte "democratiquement
satisfaisant", elle ne devrait certainement pas etre confiee exclusivement
a quelque haut conseil d'hierarques et d'experts ni meme aux parlements
nationaux.
La cooperation de la societe civile dans le cadre d'un processus du type
des conferences de consensus bien rodees dans les pays scandinaves et en
Suisse me paraitrait recommandable.
Mais les chefs d' Etat europeens ne m'ont pas paru presses d'aboutir a une
constitution ainsi conçue et la Charte europeenne des droits fondamentaux
elle-meme n'a pas beneficie des conditions d'elaboration et de commentaires
les plus aptes a susciter l'adhesion a defaut de l'enthousiasme citoyen.
Le temps de la reflexion, des echanges, des ebauches, des propositions et
debats nous est donc " genereusement ouvert ".
A nos "forums", ateliers, rencontres et reseaux de s'en saisir au mieux.
Cogitations fecondes.

interesting on the philosophical level, on the one of the history of
philosophy (see Arnold Toynbe in "L’Histoire") and on the one of the
ethics. (considerations on ethics of the Truths, more than only on the
ethics of the rights).
A "protrusion out of the knowledge" of the Being at the same time than a
"perseverance in the being" seems to me convened by the elaboration of a
Constitution, therefore by a meditation on its aim: “vital rights", ensure
for each, etc.
An effort of precise description of the guaranteed fundamental European
rights and the game harmoniously balanced of the institutions being a
matter for an European constitution would be a major imperative. Also, the
intended institutional, structural and administrative articulations to
ensure the links and to delimit the fields of skill and jurisdiction
between the "European Government" and the Governments of the European
States impose precise definitions.
So that such an elaboration can succeed to a democratically "satisfactory
text", it should certainly not be confided exclusively to some high council
of superiors and experts neither to the national parliaments.
The cooperation of the civil society in the framework of a process of the
type of the conferences of consensus well established in the Scandinavian
countries and in Switzerland would appear advisable to me.
But the European heads of State didn't appear to me in a hurry to succeed
to such designed constitution and the European Charter of the fundamental
rights itself didn't benefit from the conditions of elaboration and of the
comments the most capable to get the support instead of the citizens
enthusiasm.
The time of the considerations, the exchanges, the drafts, the proposals
and discussion is therefore "generously open" to us.
To our "forums", workshops, meetings and networks to use it at best.
