°°° Resume : Le Conseil europeen de Nice qui aura lieu les 7-9 decembre
prochains risque d'etre un echec, chaque gouvernement recherchant son
propre interet et les instances elues par les citoyens europeens n'etant
pas consultees. Or, l'Union europeenne a besoin d'etre "gouvernee" de
maniere differente et de considerer ses citoyens comme de veritables
partenaires a la negociation. °°°
Presque tous les journaux europeens lancent des cris d'alarme sur le risque
d'echec de ce sommet de Nice en raison des desaccords existant entre les
gouvernements des pays membres de l'Union europeenne.
Nous pourrions lancer notre debat sur la gouvernance democratique pour
l'Europe par une reflexion sur cet episode de la construction de l'Europe.
Les points majeurs de desaccord sont :
- la supression de la regle de l'unanimite dans les decisions du Conseil
des ministres, donc l'elimination du droit de veto.
- la ponderation des voix pour chaque pays au sein du Conseil (puissance
des pays ou nombre des citoyens ?) et les modalites de vote.
- la composition et la taille de la Commission Europeenne en vue du
prochain elargissement aux pays candidats.
Naturellement, il y a beaucoup d'autres elements de dispute qui vont de la
question des langues officielles, de l'armee europeeenne, de
l'harmonisation de la fiscalite, etc. jusqu'a la gestion de la crise de la
vache folle.
Il est evident que chaque gouvernement poursuit l'interet de sa nation, le
maintien de son pouvoir, dans une optique d'alliance entre Etats Nations
qui ne veulent pas perdre leur souverainete.
Il est de meme evident que les instances elues par les citoyens, les
parlements nationaux et le parlement europeen, sont exclues du debat et de
la negociation.
Surement, les representants des gouvernements vont trouver encore une fois
a Nice une serie de compromis.
Malgre ces obstacles et ces regressions, la construction de l'Union
europeenne se poursuit, ce qui est une bonne chose. Le probleme est qu'on
se rapproche toujours plus d'un point ** d'impossibilite **.
Il manque une circulation d'idees, la construction d'une ** opinion
publique europeenne ** sans laquelle il ne peut y avoir de democratie.
La construction de l'Europe, en tant qu'entite politique nouvelle, demande
d'inventer une forme d'Etat pluraliste qui aille au-dela de l'opposition
entre souverainete nationale, aujourd'hui fictive, et hegemonie
continentale sans l'appui des citoyens.
La "globalisation" doit etre percue non seulement a travers les limites et
les dangers qu'elle comporte mais comme un processus ouvert auquel les
peuples europeens doivent participer en tant que protagonistes pour
orienter ces evolutions.
Pour toutes ces raisons, nous avons besoin d'une Constitution europeenne
vue comme un mythe mobilisateur, une Constitution elargie au social, une
Constitution evolutive.

°°° Abstract: The European Council of Nice that will take place December

interest and the bodies elected by the European citizens not being
consulted. However, the European Union has need to be "governed" in a
different way and to consider its citizens as real partners in the
negotiation. °°°
Nearly all European newspapers launch screams of alarm on the risk of
failure of this summit of Nice because of the disagreements existing
between the governments of the member countries of the European Union.
We could launch our discussion on the democratic governance for Europe by
considerations on this episode of the construction of Europe.
The major points of disagreement are:
- the supression of the rule of unanimity in the decisions of the Council
of the ministers, therefore the elimination of the right of veto.
- the weighting of the voices for every country within the Council (power
of the countries or number of the citizens?) and the methods of voting.
- the composition and the size of the European Commission in view of the
next enlargement to the candidate countries.
Naturally, there is a lot of other elements of dispute that go from the
question of the official languages, of the European army, of the
harmonization of the taxing system, etc. until the management of the crisis
of the mad cow.
It is obvious that every government pursues the interest of its nation, the
maintenance of its power, from a point of view of alliance between Nation
States that don't wish to lose their sovereignty.
It is also obvious that the bodies elected by the citizens, the national
parliaments and the European parliament, are excluded from the discussion
and the negotiation.
Surely, the representatives of the governments are going to find once again
in Nice a set of compromises.
In spite of these obstacles and these regressions, the construction of the
European Union continues, which is a good thing. The problem is that one
always comes closer to a point ** of impossibility **.
There is a lack of circulation of ideas, the construction of a ** European
public opinion ** without which it cannot have a democracy.
The construction of Europe, as new political entity, demands to invent a
form of pluralistic state that goes beyond the opposition between national
sovereignty, today fictional, and continental hegemony without the support
of the citizens.
"Globalization" must not only be perceived through the limits and the
dangers that it includes but as an open process to which the European
peoples must participate as protagonists to orient these evolutions.
For all these reasons, we have need of a European Constitution seen as a
rallying myth, a Constitution widened to the social, an evolutionary
Constitution.
